Terms of Use

1. Contracting Party

In these Terms, "Riveryn," "we," "us," and "our" mean MyTip Innovations s.r.o. when it provides the Riveryn app, website, backend, subscription features, and support channels.

2. Acceptance

By downloading, accessing, purchasing, or using Riveryn, you agree to these Terms, the Privacy Policy, the Subscription Terms, the Wellness and AI Disclaimer, and the Apple Standard End User License Agreement available at apple.com/legal/internet-services/itunes/dev/stdeula/.

If you do not agree, do not use Riveryn. If there is a conflict between these Terms and the Apple Standard EULA for an App Store-distributed copy of Riveryn, the Apple Standard EULA controls to the extent required by Apple.

3. Eligibility and Personal Use

Riveryn is for personal wellness use by people age 13 or older who can make their own decisions about food, sleep, movement and time outdoors, or who use the app with appropriate adult and professional guidance. Riveryn is not directed to children under 13, and children under 13 may not use Riveryn. Users under 18 should use Riveryn only with a parent or guardian involved, and with professional guidance when food or exercise choices may affect health.

You may not use Riveryn if doing so would violate applicable law, App Store rules, these Terms, or any restriction imposed by Apple or another platform provider.

4. What Riveryn Does

Riveryn helps you live the hunter-gatherer day. It shows your day as one fire made of seven parts: Sleep, Sun, Move, Food, Hunt, Quiet and People. You log by tap, typed line, photo or voice. If you allow it, Riveryn reads Apple Health to count your steps and, with a watch, more.

Riveryn estimates meals, gives you one next move, and writes short notes about what your own days show. Bands let two to five people see each other's fires. Riveryn is for personal awareness. It is not clinical care, exact measurement or a professional service.

5. Wellness-Only Disclaimer

Do not use Riveryn for emergencies, eating disorder treatment, pregnancy care, diabetes dosing, allergy safety, medical nutrition therapy, medication decisions, pediatric nutrition, sleep disorders, or any medical decision. Ask a doctor before hard exercise if you have a heart, lung or joint problem, before cold water if you have a heart condition or high blood pressure, and before changing when you eat if you have diabetes, are pregnant, or have had an eating disorder. 6. Approximate Estimates

Meal estimates can be incomplete or wrong. A photo may not show weight, volume, recipe details, hidden oils, sauces, cooking method, packaged ingredients, brands, or restaurant preparation. Riveryn shows correction tools because estimates are starting points.

The fire, Riveryn's notes and any pattern come from what you log, what you tap about how you feel and, if you allow it, Apple Health counts. They are rough. They are not a measure of your health. You are responsible for checking and correcting estimates before relying on them. Riveryn does not guarantee weight loss, muscle gain, better sleep, more energy, health outcomes, calorie accuracy, or any other result.

7. Your Responsibilities

• Use Riveryn only for lawful, personal wellness purposes.
• Do not upload unlawful, abusive, explicit, private third-party, or rights-infringing content.
• Do not attempt to reverse engineer, overload, scrape, disrupt, attack, bypass access controls, or misuse Riveryn, the backend, or any provider systems.
• Do not use Riveryn to provide professional medical, nutrition, coaching, diet, or regulated advice to others unless you have appropriate qualifications and independent professional obligations.
• Keep your device, Apple account, backups, and subscription settings secure.
• Respect Apple App Store rules, payment rules, and platform terms.

8. Bands

In a band, be kind. Don't post anything hateful, sexual, threatening, or private about someone else. Don't go by a name in a band that pretends to be someone else. Share an invite code only with people who want to join.

We can remove a band, a name or a line that breaks these Terms. If someone in your band breaks them, tell us at support@riveryn.com. You can leave a band any time in You › Your band.

9. User Content and License

You keep your rights in the photos, lines, voice recordings, transcripts, corrections, band lines and other content you provide. You give Riveryn a limited, worldwide, non-exclusive, royalty-free license to process that content only as needed to provide, secure, troubleshoot, support, and improve Riveryn, and to show what you share with your band to its members, subject to the Privacy Policy.

When you log by typing, voice or photo, or ask Riveryn a question, the app sends it to our server. Our server uses OpenAI to read text and images and ElevenLabs to turn voice into text, so Riveryn can answer. Day totals you allow from Apple Health travel the same way. Our server does not keep what you send.

Our server does not keep raw meal photos, voice audio, transcripts or your lines after a request is handled. Your log is stored on your iPhone. What you share with a band (the name you go by in the band, your fire, lit parts, kept moments, warmth and any line you share) is stored on our server and shown to your band.

10. Subscriptions and Purchases

Riveryn Premium is an auto-renewing subscription sold through Apple in-app purchase. Apple handles payment processing, cancellation, refunds, billing records, subscription management, territory pricing, taxes, and purchase confirmation. Apple shows the price, billing period and offer before you confirm.

Subscriptions renew automatically unless cancelled in your App Store settings at least 24 hours before the end of the current period. Deleting Riveryn data or the app does not cancel a subscription. 11. Privacy and Data Controls

Riveryn's privacy practices are described in the Privacy Policy. The app has export and local delete controls in You › Your data. The Privacy Choices page explains every control and how to ask us to delete data on our server.

12. Intellectual Property

Riveryn, including its app, website, brand assets, designs, code, text, generated assets, workflows, and other materials, is owned by MyTip Innovations s.r.o. or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from Riveryn except as permitted by law or these Terms.

13. Third-Party Services

Riveryn depends on Apple services for distribution, in-app purchase, subscription management, refunds, device permissions, Apple Health (HealthKit), Apple Maps city search, and Apple speech recognition fallback where supported. Riveryn also uses hosting (Render), website and e-mail (Cloudflare), AI (OpenAI), speech transcription (ElevenLabs) and analytics (TelemetryDeck). Their own terms and policies may also apply.

14. Changes, Suspension, and Termination

Riveryn may change, suspend, or discontinue features, prices, availability, providers, or the app as a whole. Riveryn may suspend or restrict access if needed to protect users, the service, legal compliance, App Store compliance, security, or provider systems. You may stop using Riveryn at any time, leave any band, and delete local app data in You › Your data.

15. Disclaimers

To the maximum extent permitted by law, Riveryn is provided "as is" and "as available." Riveryn disclaims warranties of accuracy, completeness, fitness for a particular purpose, non-infringement, uninterrupted service, availability, and error-free operation.

Nothing in these Terms limits rights that cannot be limited under applicable consumer protection law.

16. Limitation of Liability

To the maximum extent permitted by law, Riveryn and MyTip Innovations s.r.o. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; loss of data; device issues; health decisions; nutrition, sleep or exercise decisions; subscription decisions; or reliance on inaccurate estimates.

Where liability cannot be excluded, Riveryn's liability will be limited to the maximum extent permitted by applicable law.

17. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless MyTip Innovations s.r.o. from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of Riveryn, violation of these Terms, violation of law, or infringement of third-party rights.

18. Governing Law and Disputes

These Terms are governed by the laws of the Czech Republic, excluding conflict-of-law rules, except where mandatory consumer protection laws in your country or state provide rights that cannot be waived.

Subject to mandatory consumer rights, disputes relating to these Terms or Riveryn will be handled by the competent courts of the Czech Republic. If you are a consumer, you may also have the right to bring claims in the courts or complaint bodies available under mandatory law where you live.

19. Apple Terms

For App Store-distributed copies of Riveryn, Apple and Apple's subsidiaries are third-party beneficiaries of the Apple Standard EULA and may enforce it against you. Apple is not responsible for Riveryn's content, maintenance, support, warranty claims, product claims, or legal compliance except as Apple separately states in its own terms.

20. Changes to These Terms

Riveryn may update these Terms as the product, business, providers, launch territories, or legal requirements change. Material updates will be reflected on this page and, where appropriate, in the app or release notes. Your continued use after an update means you accept the updated Terms, where permitted by law.
